Wire reporting: (AP, via Local 10)

A federal judge in Miami on Saturday dismissed with prejudice President Donald Trump's amended defamation lawsuit against Rupert Murdoch and The Wall Street Journal over a story about a birthday letter to Jeffrey Epstein1,2.

U.S. District Judge Darrin Gayles ruled that Trump, a public figure, had not plausibly alleged that the defendants published the article with actual malice, CNBC reported, repeating the standard Gayles applied when he first dismissed the case about six months earlier1.

Associated Press accounts carried by Local 10 and ClickOrlando said the suit grew out of a Journal story last year describing a letter the paper said bore Trump's name in a 2003 album compiled for Epstein's 50th birthday2,3.

CNBC said the Journal described the 2003 letter as bawdy and that Trump has denied sending it1.

Dismissal with prejudice means Trump cannot file another amended complaint in that district court, CNBC reported, though he could seek appellate review1.

Gayles wrote that the amended complaint tried to manufacture flaws with the investigation and that, as with the first attempt, Trump had failed, according to CNBC1.

A spokesman for Trump's legal team said the president would continue to press the lawsuit against the Journal and other defendants, CNBC reported1.

CNBC said the amended Miami filing included a claim, previously reported by Newsweek, that Murdoch told Trump on a phone call that he would handle the article1.

What happens on appeal, and whether any other defendants remain in related litigation, was not settled in the Saturday coverage reviewed here1,2.
