COLUMBUS, Ohio — Democrat Sherrod Brown could be seated in the U.S. Senate by mid-December under Ohio special-election law, weeks before other newly elected senators take office Jan. 31.

Gov. Mike DeWine appointed Republican Jon Husted in 2025 after JD Vance left the seat to become vice president1,2. Brown defeated Husted in the Nov. 3 special election to fill the remainder of that term1,2,4. Under Ohio Revised Code 3521.02, the appointment ends Dec. 15 following the special election, cleveland.com reported1.

No swearing-in date for Brown has been announced1. The next full six-year term for the seat is in 2028, according to WCPO, which carried Associated Press projections of Brown's win4.

CBS News projected Brown's victory two years after he lost reelection to Republican Bernie Moreno2. Unofficial returns compiled by NBC4 Columbus put Brown about 4.9 percentage points ahead, with roughly 4.6 million votes counted in the Senate race compared with about 5.7 million in 20243. Those totals remain subject to certification3.

Husted, speaking on Election Day, said he still hoped to pass his data-center measure in the time left1. The Ratepayer Protection Act passed the House but stalled in the Senate; Husted blamed election-year politics, while Senate Democrats said the bill only asked states to consider its protections1.

Cleveland.com noted the Senate last voted in 2025 on Dec. 18 and worked into Dec. 21 in 2024, meaning an early seating could matter in a lame-duck session1. CBS News and NBC4 Columbus did not address the Dec. 15 cutoff2,3.
