Lindsay Clancy was back Monday in Plymouth Superior Court in Massachusetts after a September mistrial in the 2023 deaths of her three children in Duxbury2.

Cox Media Group, citing Boston 25, said prosecutors asked the judge to reject a defense bid to block another trial. Her lawyers cited double jeopardy2.

Cox reported Clancy has said she killed Cora, Dawson and Callan while she had postpartum psychosis and was overmedicated. She is held at Tewksbury Hospital and is partly paralyzed after a suicide attempt2.

Cox, citing earlier reporting, said 11 jurors were prepared to find she lacked criminal responsibility and one juror favored guilt. Prosecutors said the mistrial was proper after jurors reported they were deadlocked twice, and they have not said whether they will retry the case2.

Judge William Sullivan did not rule on the dismissal motion Monday and said he would take it under advisement and decide as soon as possible, Cox reported, citing the Associated Press2.

Cox said that if she is convicted at a later trial she could face life in prison, and that if she is found not criminally responsible she could be committed to a psychiatric hospital. Some coverage, Cox said citing CNN, has mentioned a possible plea deal2.
